This privacy policy (“Privacy Policy” or “Policy”) applies to the websites located at the following domains (“Websites”):

  • www.etsexpress.com
  • www.etsexpress.ca
  • portal.etsexpress.com
  • billpay.etsexpress.com

These websites are owned and operated by ETS Express and its affiliated companies, (collectively "ETS Express", "we", "us", or "our").

We respect your privacy and are committed to maintaining and using any information we collect through your use of the Websites responsibly. This Privacy Policy addresses our use and disclosure of the information we collect from you, which includes PII ("PII" or "Personal Data"), as well as non-PII. Please read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices, then please do not use our Websites. By using our Websites, you agree to the terms of this Policy.

This Policy may change from time to time (see below, “Changes to this Policy”). Your continued use of our Websites after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

What Information We Collect

In the course of using ETS Express as a preferred supplier, you may have the opportunity to voluntarily submit PII. (e.g., providing profile information or providing an e-mail address) through our Websites and in responding to our surveys. PII is any information that can be used to individually identify you from a larger group. We collect PII from you at several different points on our Websites. We strive to limit the PII collected about you to information that is required for conducting our business and offering products and services that might be of interest to you.

We may collect the following PII on our Websites:

  • First and last name
  • Contact information, including email address and IP address
  • Payment card information (for purchases)
  • Demographic information such as zip code, preferences and interests
  • Other information relevant to customer surveys and/or offers

When you send us an email or Live Chat message, we will retain the content of the email, your email address, and our response, in order to handle any follow-up questions you may have. We also use it to measure how effectively we address your concerns. Please know that email messages sent to our Websites may not be secure. You should not send confidential information by email. If you choose to do so, you accept the risk that a third party may intercept email messages.

Automated Information Collection Technologies

In addition to the information that you provide to us directly, we may also collect information about you during your visit to our Websites. We collect non-PII about your visits such as internet service provider, browser type, and pages accessed on our Websites to optimize your user experience and enhance your time spent with us online. We also receive information telling us about any website from which you came.

We collect this information using some or all of the automated tools that are detailed below. These tools may collect information about your behavior and your computer system, such as your internet address (IP Address), the website pages you have viewed, and the actions you have taken while using the Websites.

Cookies

When you access the Internet, the computers that host websites you visit (web servers) automatically receive some anonymous information. This "usage data" may include a record of which pages a web browser has visited. ETS Express’ servers receive usage data when customers visit our Websites. ETS Express may use various kinds of software devices to collect information about the internet use related to our Websites. Small files called "cookies" may be attached to your web browser. These files identify your browser and may save information such as passwords so that our Websites can recognize you when you return.

We may use the following categories of cookies on our Websites

  • Strictly Necessary Cookies. These cookies are essential in order to enable you to move around the Websites and use its features. Without these cookies, services you have requested, such as maintaining a record of your purchased items (e.g. a shopping cart), cannot be provided.
  • Performance Cookies. These cookies collect anonymous information on how people use our Websites to help us understand how you arrive at our site, browse or use our Websites and highlight areas where we can improve, such as navigation. The data stored by these cookies never shows personal details from which your individual identity can be established.
  • Functionality Cookies. These cookies remember choices you make such as the country from which you visit our Websites, your preferred language, and your search parameters. This information can then be used to provide you with an experience more appropriate to your selections and to make your visits to our Websites more tailored to your preferences. The information in these cookies may be anonymized. These cookies cannot track your browsing activity on other websites.
  • Targeting Cookies or Advertising Cookies. These cookies collect information about your browsing habits in order to make advertising more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of an advertising campaign. Overall, cookies help us provide you with a better website by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us. You can choose to accept or decline cookies. Web Beacons. A Web Beacon is an electronic image. Web Beacons can track certain things from your computer and can report activity back to a web server allowing us to understand some of your behavior. If you choose to receive emails from us, we may use Web Beacons to track your reaction to our emails. We may also use them to track if you click on the links and at what time and date you do so. Some of our third-party marketing partners may use Web Beacons to track your interaction with online advertising banners on our Websites. This information is only collected in aggregate form and will not be linked to your PII. Please note that any image file on a webpage can act as a Web Beacon.

Embedded Web Links. We sometimes used embedded web links. Such web links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link. The tracking is often accomplished through a redirection system. The redirection system allows us to understand how the link is being used by email recipients. Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the PII that we hold about you. This data is used to improve our service to you and to help us understand the performance of our marketing campaigns.

Third-party Websites and Services. We work with a number of service providers of marketing communications technology. These service providers may use various data collection methods to improve the performance of the marketing campaigns we are contracting them to provide. The information collected can be gathered on our Websites and also on the websites where our marketing communications are appearing. For example, we may collect data where our banner advertisements are displayed on third-party websites.

Google Analytics. We use Google Analytics to improve our services and the effectiveness of the Websites. The Websites sends aggregated, non-PII to Google Analytics for the purpose of providing us with the ability to conduct technical and statistical analysis on the Websites’ performance. How We Use and Share Information We Collect

We use this information to better understand your needs and provide you with a better service, and in particular for internal record keeping. We do not sell or rent our customers' information to any outside company or third party organization.

In addition to the uses described above, we may use the information we collect:

  • to improve the content of our Websites.
  • to notify you about updates to our Websites.
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • to contact you for marketing purposes.
  • in any other way we may describe when you provide the information.
  • for any other purpose with your consent.

We may disclose information that we collect or you provide as described in this Privacy Policy

  • to all ETS Express offices world-wide.
  • to contractors, service providers, and other third parties we use to support our business, such as our third party payment card processor, our shipping vendors for the processing of customer orders, or our web developer for improvements to our Websites.
  • to analytics tools for the creation of personalized digital content or for email marketing activities.
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ETS Express’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which information held by us about our Websites’ visitors is among the assets transferred.
  • to law enforcement as required to comply with applicable laws.

Your Choices and Selecting Your Privacy Preferences

We want to provide you with relevant information that you have requested.

If we provide subscription-based services, such as email newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed. Transactional or service-oriented messages are usually excluded from such preferences, as such messages are required to respond to your requests or to provide goods and services, and are not intended for the purposes of marketing.

We will not intentionally send you email newsletters and marketing emails unless you consent to receive such marketing information. After you request to receive these emails, you may opt out of them at any time by selecting the “unsubscribe” link at the bottom of each email. Please note that by opting out or unsubscribing you may affect other services you have requested we provide to you, in which email communication is a requirement of the service provided.

Text Messaging

In using our services or visiting our Websites, you may have the opportunity to receive SMS or "text" messages, pre-recorded voice messages or auto-dialed phone calls from ETS Express, its affiliates and related entities as well as third parties. Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested. In providing your mobile device number or cell phone number to ETS Express, you knowingly consent to such communications from ETS Express or for ETS Express to use your cell phone number or mobile device number in accordance with ETS Express’ Terms of Use. In providing your number, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to ETS Express, or from which you sent the text message request to us. You further acknowledge that no purchase is required to opt into this service, and you may opt out at any time by following instructions from ETS Express and as described in the Terms of Use.

Any such text communications you receive from us will be administered in accordance with your preferences and this Policy.

Payment Processor

We utilize a contracted and trusted third party to process all of your purchases made on the Websites ("Authorize.net"). Our Payment Processor, or ETS Express if you place an order over the phone, collects the necessary PII to process your payment, including:

  • first name
  • last name
  • payment card number
  • CVV, CVN or other security code

We will also process any other information needed to facilitate your purchases. The Payment Processor's use of such PII may be subject to its own privacy policy. We only receive information related to the payment status of your account, which does not include your credit card number or other financial account numbers. We recommend that you review the Payment Processor's privacy policy and any applicable terms of use.

Note Concerning Minors

The Websites, and the content available on the Websites, is neither intended for, nor directed to, minors under the age of 18. Additionally, you must be at least 18 years old to have our permission to use our Websites.

For Visitors of our Websites Outside of the United States

Our Websites are designed for use by individuals in the United States and Canada only. We do not warrant or represent this Policy or the Websites’ use of your PII complies with the laws of any other jurisdiction. Furthermore, to provide you with our services, we may store, process, and transmit information in the United States and other locations around the world, including countries that may not have the same privacy and security laws as yours. Regardless of the country from which you access the Websites or in which such information is stored, we will process your PII in accordance with this Policy.

Data Storage and Retention

We store your PII on our servers and the servers of third party service providers. We retain your PII for the duration of the business relationship and for a period thereafter to allow you to recover your account information, to analyze your data for our business operations, meet our legal obligations, for archiving purposes, and for any other general purposes for which you would expect in providing our services to you. Your California Privacy Rights

If you are a California consumer, as defined by the California Consumer Privacy Act of 2018, you may be afforded additional rights with respect to your “PII” as that term is explicitly defined under California law. Any PII we collect is collected for the commercial purpose of effectively providing our services to you, as well as enabling you to learn more about, and benefit from, our services. You may exercise each of your rights as identified below, subject to our verification of your identity.

Access. You may email us at privacy@pcna.com to request a copy of the PII our Websites’ databases currently contain.

Prohibit Data Sharing. When applicable, you may prohibit the sharing of your PII by submitting a request via email to privacy@pcna.com. In your email, please explain how you wish us to prohibit the sharing of your personal data, and which categories of third parties you want to prohibit from receiving your PII. When such prohibitions are not possible to provide our services to you, we will advise you accordingly. You can then choose to exercise any other rights under this Policy.

Portability. Upon request and when possible, we can provide you with copies of your PII. You may submit a request via email to privacy@pcna.com. When such a request cannot be honored, we will advise you accordingly. You can then choose to exercise any other rights under this Policy.

Deletion. If you should wish to cease use of our Websites and have your PII deleted from our Websites, then you may submit a request by emailing us at privacy@pcna.com. Upon receipt of such a request for deletion, we will confirm receipt and will confirm once your PII has been deleted.

Where applicable, we will ensure all such changes are shared with trusted third parties.

No sale or sharing of PII for Third Party Benefit. We do not disclose or share your PII with third parties for any third party’s purpose of marketing its goods or services to you without your prior consent. We do not sell your PII to third parties for any purpose. In the event we should ever commence the selling of your PII or sharing of your PII for this third party marketing to you, we will provide notice of such practices, and provide you the opportunity to opt out of such selling or sharing for third party marketing purposes.

Do not track. To better serve you, our Websites track users over time and across thirdparty websites to provide targeted advertising. The Websites do not operate any differently when it receives Do Not Track (“DNT”) signals from your internet web browser.

No discrimination. In addition, if a California resident exercises his or her rights under California law, including the CCPA, we shall not discriminate against that California resident by denying our goods or services, charging different prices or rates to similarly situated consumers, providing a different level or quality of our goods or services, or taking any other adverse action.

Security

We have implemented commercially reasonable measures designed to protect your information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Please report any incidents involving your PII or your credentials to ETS Express as soon as possible.

Links to other websites

Our Websites may contain links to other websites of interest. However, once you have used these links to leave our Websites, you should note that we do not have any control over that other website. We are not responsible for the content of such websites or the protection and privacy of any information which you provide while visiting such sites. Third-party websites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

Access and Integrity of your PII.

If you believe that any information we are holding on you is incorrect or incomplete, please email us at privacy@pcna.com. We will work with you to make any corrections deemed necessary. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Changes to this Policy

If we make any changes to this Policy, a revised Policy will be posted on this webpage and the date of the change will be reported in the “Last Revised” block above. You can get to this page from any of our webpages by clicking on the “Privacy Policy” link (usually at the bottom of the screen).
